To His Honor the Judge of the County Court of the County of York. The petition of the undersigned ar sessed freeholders and householders ( the United School Sections numbt three and four. of the Townships 0 Markham and Vaughan, which now in eludes the recently incorporated villug of Richmond Hill, SHEWETH: 1.â€"That your petitioners are ratepay- ers and assessed fréeholders and hou'se- holders of the Union School Sections aforesaid. 4.â€"-That in pursuance of said notice, an illegal election ol Schpol Trustees was held. Your petitioners therefore pray that an investigation into the mode of conâ€" ducting, and legality of, said election may be had, pursuant to section 72 of chap 64, of the Consolidated Statutes of Upper Canada, and that said election may be declared illegal and set aside, and a new election directed to be held, upon the following grounds of complaint. 2.â€"â€"That no proper or lawful election of School Trustees for said sections, or inéorporated village of Richmond Hill, has been held for the current, year. 3.â€"That Matthew Tcefy, Returning ()fliccr for the said village of RichmOnd Hill. issued an illegal notice, calling a meeting for the election of School Trus- tees for the said village of Richmond Hill,,,for the twept-y-sevemh day of J anu- ary, 1873. 5.~â€"Thatr said election was a contested election, and the said Matthew Teefy, Returning ()flicer' aforesaid, improperly elected himself a School Trustee for the said sections. 1.â€"Tha{ the said Returning Oificer had no legal authority to can said meeting. Mr. Boyle was the only person present W110 desired to have a record made of objections to proceedings; but he was not denied, nor did I refuse to allow him, or any other frecholder or householder} prcSent to participate in the proceedings, after Mr. Robert Marsh showed me a letter which he received from Dr. Hod gins. In fact, after reading that letter, and before proceeding to open a poll, ] publicly declared to the meeting that 1 would accept Dr. Hodgins’s opinion, :ontained in his letter, as authority; hat I would accept the votes of all free- mlders and householders in the School ection, whether within or without the .‘illage boundaries. Several parties re-, siding outside the village boundaries‘ availed themselves of my announcement and voted. As soon as I made known my intention of accepting votes from all ratepayers in the school section, Mr. Robert Marsh publicly declaredrthat he was “perfectly satisfied,” and withdrew his objection to my proceeding; he after~ wards “ went back” upon' this public (leo claration, and signed a paper charging me with everything objectionable; he went forward as a. voluntary witness be- fore Judge Duggan in Toronto. and there tried to qualify the public decla- ration he made at the meeting, by trying:r to tack on the words, “on that point,” to l‘is, saying that he “was pert’eetl-c satisfied,” forgetting at the time that the fact of withdrawing his objection to my proceeding, was evidence that he did not reserve his objection on any point. He also had the hardihOod to deny one ot my statements on oath before Judge Duggan; but, to his astonishment, he was promptly confronted by W. 8. War- ren, J.P., who at once corroborated the truth of my statement, to the utter conâ€" fusion of Mr. Marsh, who had forgotten that Mr. \Varren was present when the circumstance that I referred to took place between Mr. Marsh and myself. Reply to charge 5â€"Before entering upon my duties as Returning Ufiicer of the village of Richmond Hill, I made and subscribed the declaration of' ofiice; it is by virtue of my position as such Returning Oflicer (see section 66, clmp‘ 6-1, Con. Stat. of U. C. before cited.) and having taken my declaration.as such. that I was compelled by law to call and preside over said school meeting, no other declaration was required of me until after thu election was closed, which was duly attended to. Reply to charge 6 â€"In my capacity of Returning Officer of the village, I was compelled by law to preside at the school meeting, and was to all intents and pur poses the chairman; and as such was eligible to be a candidate for the office of School Trustee, after having been nomi- nated and seconded; see Ontario Statutes, 1870-71, chap. 34, section 24; and also Dr. Hodzins’ School Law Lectures, part 2, page 120, as well as part 1. page 10. 'chIV to charge 7â€"As Réturning Ofliccr for the first election for a newly erected Municipality, for which there was no separate assessment roll (see Unr- rinon’s Manual of‘1867.pnges 62 and 63), I recorded the votes- tendered, against which there was no objection, or challnnge madp, as referred to in section 17, chap- ter 64, consol. Stat. of Upper Canada. In doing so. And on the day after the close of the election I returned the poll book to the Secretary of' the Public School Board; I did also append to the said poll book my solemn declaration that the poll book contains a true statement of the poll: and did at the same time hand him my Certificate for the persons who were duly elected. viz: W'illiam Trench, Junior, David lloyle, Robert Marsh. Matthew Teef'y, William Harrison. and James Newton, Junior; all'of which is accordingr to. the Municipal Law, as referred to by Doctor Hodcins in his School Law Lectures, part 2, page 117_. 'At the hearing in chambers on the 19th February, Judge Duggan exonera- ted me from any desire to do wrong; on the contrary,he remarked that I appeared to have taken pains to try and be right, and that he saw nothing in my conduct to deserve censure. 7 It will be observed that the petition- ers,â€"among whom is Mr. James M. Lawrence, the Secretary of the Board of 'l‘rusteesâ€"say that “ no proper or lawful “election of School Trustees for said .“ section or incorporated village of Rich “ mond Hill has been held for the cur- " rent year." It is a well-known fact that the Secretary of the Board of Trustees issued the usual notices for a school meeting to be held on the second Wednesday in January, in the school house, and that such meeting was held, at which Mr. William Trench J12, was elected a trustee. Mr. Lawrence figured as large as life at this meeting, with much pomp and circumstanceâ€"although his school report was anything but satisfac- tory. Is the public to understand that Mr. Lawrence acknowledges, by signing ‘ the petition referred to,that he was instru~ mental in calling an improper and un- lawful meeting?
