As the circumstances under which plaintiff wed in these suits were some- what similar, the parties agreed to haVe them tried. together. The plaintiff, who is a. nurseryman, sued for payment of price of certain fruit trees under orders given him by the defend- ants, and which he had delivered to them. Defendants denied liability, for that they had ordered the trees for plant- ing nun last fall, but the trees had not been delivered to them until the month of November last, when the winter had set in, and the ground had frozen a few inches, and that when ()fl‘ered them they h {d refused to accept of them because not delivered as ordered. They further subâ€" mitted that from the very nature of the trees, time was a necessary part of their orders, and unless the trees had-been deâ€" livered in time to be planted out and a growth set in, they were practically use- less tn them. When the orders were produced in Cum-t, it was found that there was a dif- ference in the original orders signed by the defendants and the ones handed them as a true copy by the plaintiff at the time the orders were made. The former, re- lating that the trees were to be delivered “in October or November,†whilst in the latter the words “or November†were Omitted. Defendants" evidence, which was supported, went to show that the words “or November†were not on the orders when they signed, and that at the time the trees were ordered the distinct understanding was that the trees were to be delivered in time for planting out in the fall. The trees had not been deliv- ered until about the 12th of November last, when the frost was in the ground, hence too late for fall planting. Mr. Lawrence,0f Lawrence & Milligan, for Defendants. Several changes have or are about to take place in our village. John Ramsden, Esq., has sold his residence to P. Phalen. Esq, at a. good advance on the price paid by him; Mr. R. intends moving to North Toronto on the ï¬rst week of April. Mr. Jae. Millyard has sold his property to Mrs. Pexton. W. B. Willson will not leave for North Toronto until some time in April. Nlr. Bell. of Milliken, will oc~ cupy Mr. Bowman’s place in a few days. Mr. J. S. VVatei'ï¬eld has removed his family to W'eston; his house will be cc- cnpied in a. short time. Mr. Staplemn, of York Township, will soon occupy Mr. Gallnnough’s house. Mr. B. Musselman, so well and favor- ably known throughout Vaughan, met with a very serious accident last week. He and another party were riding upon a load of hay when suddenly a gust: of wind upset the load; Mr. B. falling dislocated his shoulder and broke his leg. After the limb had been set, he had another fall in his own room; he is a heavy sutferer The mumps still continue their ravages among the young people of the village; no fatal case has been heard of yet. The sufferers say that solid food should not be indulged in to any great extent when the disease is at; the worst. Farewell banquets are in order just now. The intimate friends of those leav- ing us will be honored by an invitation to some of the social gatherings. Strange that friends have to threaten to leave be- fore their Worth is fully appreciated, and it is astonishing to them also that they have so many friends. Rev, J. Malmn, of Newton Brook, was in the village one day last week; he call. ed at the parsonage. The shed at the church will soon be completed, after the very successzful social held at Mrs. Wilson’s in its behalf; some- thing less that $30 was realized. In all probability another will be held in the same place next June. Stir-ring times are anticipated in school matters, which may probably lead to a dissolution of the section. Division Court. Thornhill To the Editor of THE LIBERAL :' SIR,â€"â€"In last. week's issue of your pa.- per we ï¬nd a. communication from “Jer- emiah Strawteet,†which we cannot let pass without an answer. In the ï¬rst place we charge him with claiming to be a resident of this place, which he is not or ever was, nor can he even claim to live in the suburbs, and his only connection with this place at the present time or in the past amounted to this much: getting his mail here, occas- ionally driving through here, and a. visit like one he made a few days ago hanging around, trying to squeeze himself into the good graces of a few to get invxted to a. party. His garbled version and attack on Sherwood items of Feb. 24th, plainly shows that his ï¬rst attempt is a. complete failure. In the ï¬rst place he is bringing.r into print the names (1 some who are so far above him in intelligence and social standing. In the second the nngentle- manly manner of doing so plainly shows that his ideas of fair play through the columns of a paper are very limited, and the sooner he drops his share of the play- ful controvery (kindly allowed by the editor) the better for himself. There is a certain amount of respect due even to a “Nigger,†although his feet are large, but when you draw into and put up for ridi- cule men that have no hand in or are in the least concerned in these controversies then I say you do a mean action one that any gentleman would scorn to do. Ohi- little village at the present time is at a complete standstill, not that we ever we’re very notonous. r But there is one bright prospect in View when the Spring opens up of our gaining notoriety by being washed out of existence if that one particular water- outlet is not opened up. Where is our worthy pathmaster? ' The principal happenings at present are surprise parties, loafing (a scion of the N. R), and local spate on the past elec- tion; both parties clalming that corrupt practices and lots of handle were passed around from the worn and weary faces of some of the disappointed aspirants. I do not think there was much boodle struck this town. A good moral might be taken from the following: A few nights ago a couple of our village belles hit upon a novel plan 1;) vis1t a former resident of this place. Forming themselves into a committee of two they decided to lay aside all the an- cient and time-worn custums for a cen- tury buck, and adopt the following.â€"â€"F0r the committee to chose from the invited ones for Mr. Sn-and-So to take Miss So- and-So under their protecting care for the evening, or in plain English to palm off on you some other fellow’s girl, which is against all the laws of human nature. ConsequenCe: The committee uf two and two added to their number being the only ones present. Mural: Chose your own partner, and let others do the same. Some would lead us to believe that we had an epidemic of measles herv. I have heard of one case, a grown up person, and I think all ideas of that kind would be scattered if our rising generation could be seen. Our newly-organized lodge of k. 0. U. W. seems to be taking well, new initia- tions being quite frequent. 1 think it. is a. worthy organization and the object. in View cannot but recommend itsulk to (our surrounding neighbors. Our old friend the “Dutchman†is still living, and says it will take bigger feet than "Jei'eiiiiah†has to trample him out of existence, and the reason he took “Strawfeet†for his nom‘dc plume was that his feet were so big he could not take them in the house at nights, but covered them up with straw and left them in the stable, hence stmwfeet. FAIR PLAY. Sherwood, March let, 1887. Clxilblains and frosted feet and hands cured with a few applications of West’s World “’01)er or Family Li‘niment. All dl‘l'lgglsts. From our own Correspondent. A free entertainment was held in the school house on Thursday evening,March 17th. The programme consisted of diaâ€" logues, recitations and. singing by the children, and readings and recitatiuns by others. At the close. everybody seemed to be well pleased with the exercises of the evening. ‘ Mr. Jos. McLean has left our village, and has gone. to live near Teston. Surprise parties have been plentiful this wink r. I . D. Snider has had hls share, havng 1) sevm) of them. West’s VHa-flr‘l’s Wonder is the harvel oi Milky an}; v: to all other limlhcnts. But we expect it will get livelier as the warm weather sets in. The lacrosse tean is shortly to be re- organized. I think their chances are gogd fqr the Vmedralr. A There is a great opening here for n. shoddy mill. As our town is situated in a good section country a. stirring man would make money. The boys that left here for Woodstock are greatly taken up with the town, but not with the Scott Act; they think that it is the whiskey act instead of the other. Parties seem to be the leading event in thgsnrrqunding country. Mr.J.Prentice has been visiting friends “HWeSE: Miss Oampbéll, of Sherwood, is visiting with Mr. N. S. Reaman.
