They have obvious- ly given a good deal of thought to this decision and I support them in it. Consider the facts. The presently planned provin- ‘cial alignment for Highway 407 ‘goes through a very heavily de- 1veloped area south of Wood- ‘bridge. It is an industrial area. \An area which provides the township with a much needed. man-residential, tax base. Bull- Idozing a super highway through pthis area would be expensive . .. needlessly expensive . . . both in the cost of land and in the loss of tax revenues which would re- sult. Ygar After Open Heart Surgery Furniture Store Employee Faces Charge Of Assault On Customer Details of how a local furni- ture store employee got involv- ed in a fracas with an unsatis- fied customer who recently had his chest opened for ppen heart surgeryâ€"were revealed in Rich- mond Hill Provincial Court on Thursday of last week. The complainant was Carl Kellen, aged about 55.. from Metro. He said he went with his daughter-in-law and wife to Liberty or Highpoint Furniture Limited on the northeast corner of Highway 7 West and Keele Street in the Pinecrest area of Vaughan Town on the morning of December 28. Their pur- pose was to recover some table leaves that didn‘t fit and a chair cushion that was torn after the Barry McDonald, 38, of 171 Orchard Heights Boulevard. Aurora. faces a common assault charge. Complainant Kellen said he asked at: the store for Proprieâ€" tor Goldberg, but. Goldberg wasn't there and they found McDonald: He asked for return of the items. saying they had waited too long and had come to get them for repair else- where. Michael Miles, 18, of 2958 lslington Avenue was one of three youths in the court admitting Narcotics Act offenses. The federal prosecutor told the court Miles was arrested on Highway 7 in the Woodbridge area January 26 when York Regional‘ Police Constables James McKeegan and Lee Wilson checked three occupants of a truck. A cigaret containing about 0.80 grams of marijuana was found in a cigeret package belonging to Miles. 0 Caught with a marijuana cigaret on his pre- nuptial stag party night, an 18-year-old Vaughan groom found himself in Richmond Hill Provincial Court last week with a $50 fine and two years of restricted living. Kellen said in November, 1970 he had open heart sur- gery, had his chest opened up from the neck down, and had it wired together again. In answer to questions by Mc- Donald’s defense attorney. Kel~ len said money never entered the discussion while he was at Highpoint Furniture, that he assumed his children had paid what was owing. and it was the first time he had ever seen Mc- Donald. He said $2,500 was the price of the furniture purch~ ased. Complainant Kellen said his wife had the cushion and he picked up the box and started out. There was another com~ motion. McDonald was holding Mrs. Kellen, shaking like heck and saying, “Leave me alone." when she was holding the cush~ ion in both hands and wasn’t doing a thing to Mr. McDonald. Kellen said he was surprised to see McDonald yelling “leave me alone" and Mrs. Kellen say~ ing, “I’m not holding you, I‘m holding the cushion”. Kellen said he was so fright- ened because McDonald was "banging me in the chest and shoulders with both hands... trying to push me out of the building. Daughter-in-law Iris was fear- ful for her father and was yell- ing. “Leave my father-in-Iaw alone. don't touch him. Then mefl‘ Kellen. nearest 1 a charge Questioned closely about the events, Kellen said again he told McDonald he didn't think a reputable firm 'would take so long making repairs. when Mc- Donald began calling names and grabbed the box away. Kellen said he believed Mc- Donald was unaware of what was happening to him. “What he was saying Was very odd," said Kellen. Mrs. Celia Kellen took the stand, explaining the table leaves in question didn’t fit the table because the dowels were in the wrong place. making them completely, useless. She said her husband felt Highpoint wasn‘t a reputable firm to deal with. She said the seat was given to her. She said McDon- ald took hold of her with such Violence that she had a bruise on her arm the size of an orange. . .Questioned by McDonald's at- tomey as to whether they were given possession of the items. Mrs. Kellen said McDonald said "There it is. take it. I have no intention of fixing it." She said she was grabbed when her husband sent her to call the police. She admitted she might have elbowed McDonald in the stomach to get free. Daughter-in-law Mrs. Iris Kil- len corroborated the evidence given by her in-laws. admitting that she still owed $100 on the furniture.
