New laws providing for dis-‘ coff told the court McVey was charge of guilty drug users and caught June 3 in Markham with criminals without conviction or sentence were tried out in Richmond Hill Provincial Court on Thursday of last week. Judge Russell Pearse found guilty of stolen goods posses- sion an old man with a good life record as a citizen and gave him an absolute discharge. This means the old man has no crim- inal conviction or record. But the judge refused a re- quest for a conditional dis- 2.7 grams of hashish said to be worth $10. He said the youth hadn't any criminal record and‘ that a conditional discharge was asked. The arrest followed a com- plaint of a party in a conserva- tion area and seven youths were found in the area. McVey was checked and admitted owner- ship of a plastic bag containing hashish that had been thrown in some bushes. But the judge refused a re- quest for a conditional dis- charge to a young Toronto par- ticipant in 3 Markham drug smoking party. A conditional discharge would have meant the youth woud have no con- viction or criminal record if he stayed out of trouble during a ‘period of time fixed by the judge. » YEAR‘S PROBATION Instead Judge Pearse convict- ed David McVey. 19. of Don- lands Avenue. Toronto. He sus- pended McVey's sentencé for a year and put him on proba- tion. Judge Pearse said there would be no deterrent to drug use if the court started grant- ing discharges to guilty users. "There has been nothing shown to me that these drugs are any good to anyone. They should be under strict control. The youth caught. using drugs has a chance to get off without a fine or jail sentence if he behaves himself to the judge‘s satisfaction during the‘ year of probation. But if he misbehaves he can be brought‘ back, fined and jailed. i N0 CRIME RECORD ‘ “When dealing with a person who knows the law and con- tinues to break the law. I don't think the coart should back away from any deterrent,†said Judge Pearse. This was when the free legal aid attorney present in the court argued that a conditional 'discharge would have the same effect of requiring the youth to behave while at the same time avoid- ing the stigma of a criminal record. I’m not convinced there should be no punishment." he said. (Continued from page 1) One other highlight was the ousting of Dynes‘ Manager Rus- sell "Casey" Cripps from the Hay River game. Manager Cripps protested vehemently over an umpire’s decision and got the traditional thumb. Dynes 7, Nova Scotia 1 Domik was the winning pit- cher allowing four hits while striking out nine and walking two in the seven inning game. Loser was Terry Gallamore with seven strikeouts and five walks. Jewellers Deposed As Canadian Softball Champions Downing was the big gunner for Richmond Hill in this one with three runsâ€"battedâ€"in. The lone run off Domik came in the sixth as Lyle Carter homered with one out. Dynes 2, Edmonton 1 Domik was the winning pit- cher in this one also as he took over in the wake of efforts by starter Drennan and reliever Ken Rhora. Drennan went one third of an inning, Rhora four innings and allowed four hits, one walk. while Domik replaced in the fifth and went three and two third innings. ’ This game went eight innings and was highlighted by con- tinued disputes on calls by the umpires. EARLY DYNES GAMES RESULTS Drennan ran Into trouble in this one as the plate um- pire continually warned him about the way he was pitching claiming it was illegal. Domik was also plagued by the umpires throughout the tournament despite the fact he’d pitch- ed all over Ontario and in the World’s Tournament with no complaints. Edmonton scored its one run tying the game up in the second on De Ruiter‘s long, high home- run. Richmond Hill finally won it in the eighth as Domik singled, Smith walked. and Downing doubled Domik home. Dynes 8, Newfoundland 0 Drennan went all the way in this one in a fine display allow- ing only five hits while striking out 10 and walking two. The Jewellers managed nine hits off the opposition. Richmond Hill scored three in the first, one in the second, two in the fourth and sixth. Donnie Lee led the hitting Crown Attorney Frank Mos- FRANK A. But he said the house was in dere- lict condition and the items were either in a trash barrel or rusty and thrown about the floor. The house was unlocked and a window was open. The owner said he left them in good order in the recently purchased and_ locked house. N0 CROWN OBJECTION "Here is a man with a long record as a good citizen, who in a moment of weakness took something he shouldn’t have," said Judge Pearse, proposing to grant an absolute discharge to the guilty man if the Crown didn't object. Crown Attorney ~Moscoff didn't object. Judy Pearse said “he hoped the guilty man Would return the items taken. Dynes 6, Hay River 2 An exciting contest which was highlighted by DeRuiter’s dra- matic blast in the 10th inning with the score tied at 2-2. That 10th saw Ken Rhora singling. Kinnersly singling and Smith walking. DeRuiter then tagged 3 Wally Dick pitch and drove it far over the scoreboard in centre-field which is located 255 feet from the plate. ‘ The winning pitcher was Rhora who replaced Domik ‘ in the seventh inning. Domik was taken out after repeated harrasing from the plate umpire over his pit- ching style. Dynes 3, British Columbia 1 Another excellent game for Drennan as he tossed a two-1 hitter "while striking out three and walking only one in a five- inning relief job. DeRuiter Radio Programs Not To Vandals Liking? York Regional Police are wondering if a Richmond Hill vandal had something against the radio programs being aired on the weekend. Five residents and a visitor of an apartment house at 165 Colbourne Avenue told police that the aerials on their cars had been broken off, while their cars were parked on the apartment lot. Victims were Nelson Gilroy, Bill Alexander. Francis Ahern. Van Kelly and Denise Davidson, all of 165 Colbourne. and Wayne Stewart of Newmarket. Suffered Heart Attack He admitted taking the items Rev. Clarence Thomas Bass, a former missionary to India, died of a heart attack in his car early August 31 while driv- ing to his home in Gormley from Toronto. He spent two, seven year terms in India where he worked among the untouch- ables in villages near Hindupur ‘in the southern part of that country. Former Missionary To India Rev. Clarence Bass Dies Suddenly He had some medical training so he both preached and helped medically. In the early 1950’s when a devastating drought hit Southern India, money was raised in Canada to help save the Indians from starvation. Mr. Bass bought grain with the money allotted to him and used; this commodity to pay the men to dig a well in Kadiri. They had to go extnemely deep and blast through layers of rock with dynamite. The result was a well for the untouchables who were not able to use other wells. This area is again ex- periencing drought and the on- ly well still producing is the Lone built by Mr. Bass. He went to India in 1938 and joined the Ceylon and India General Mission of the Inter- national Christian Fellowship. After his first term of service he became Canadian secretary of the International Christian Fellowship in 1946. Two years later he returned ’to India. Crown Attorney Moscoff said Kirkpatrick had a breathalyzer test reading of 2.80. QUIET DRUNK “Isn‘t that one of the highest readings in this court. I‘d think a person with that would be quite drunk," said Judge Pearse. “It‘s getting up there your honor." replied Moscoff. Judge Pearse fined Kirkpat- rick $200 and reminded him the conviction meant a three month suspension of driver’s license by the Transport Department. COULDN’T PARK Kirkpatrick tried unsuccess- fully to park twice after no- ticeably slamming on his brakes opposite the Pine Restaurant in Woodbridge. This was after watching television with a friend, the court was told. Richard MacFarlane. 18, of Dundurn Crescent, Toronto and Robert Finnegan. 18, of RR 1. Unionville, were before the court facing more than 20 break-in and theft charges. The alleged offenses were in Mark- ham and Metro. Judge Pearse placed them on‘ $1,000 bail without deposit be- cause he felt there were no charges of a nature serious enough to warrant holding them in custody. They were re- manded for a week to appear in court again to set a trial date. They are to report at the police station in Button- ville every Wednesday evening. Osborne Trussler. 34. of Van-‘ couver. was brought before the court to face a charge of as- saulting Manager Peter Fabian at the Oaks Motel in Oak Ridg- es. Richmond Hill managed seven hits off loser Dave Ruthowsky. British Columbia got its lone run in the second inning but Richmond Hill came back to go ahead in the fifth as Chapman singled, stole second and then third on the over-throw. He ‘then came home on the same play as the centrefielder kicked the ball around. 2 Local Fire Fighters Technology Graduates Their final run came in the same inning as Mike Thompson singled and Kinnersly doubled. Smith brought them both home with a double. Two top local fire fighters graduated recently from the 22- week Fire Protection Technolo- gy Course at the Ontario Fire College in Gravenhurst. At the completion of their advanced studies in fire preven- tion. fire protection and fire department management they were presented with diplomas by the Ontario Fire Marshal. Captain Lloyd Palmer of 26 Church Street, Maple, is a vet- eran of nine years as a perma- nent full-time member of the Vaughan Fire Department and was a volunteer for 31 years be- fore organization of the Vaugh- an permanent force. Captain Robert Kennedy of 47 Markham Road has been a full-time firefighter with the Richmond Hill Fire Department for five years and was a volun- teer with the Aurora Fire De- partment for several years. In the mid-1950’s the Basses returned to Canada for health reasons. Mr. Bass preached to churches of several denomina- tions and started a Bible class in Toronto. It continued until about a year ago. In 1960 he became minister of the Stouffville Memorial Christian Church and remained there for 10 years. Last year he moved to Gormley and again preached to several denomina- ltions. He was scheduled to speak the Sunday following his death at the Brethren In Christ Church at Heise Hill, Gormley.
