Sheriff said he realized the use of marijuana is really an attitude which the jail isn‘t going to change. He noted the previous June 19 conviction and $75 fine of Malcolm Conyers. 19. of 36 Woodbridge Avenue, Vaugh- an. didn‘t deter Conyers from having the illegal drug and hadn‘t stopped a contin- uous pattern of use. ALL USE DRUGS Conyers and two other accused youths all indicated in court that they indulge in marijuana when they like and most of their friends do too. But the other two. Jos- eph Gabrielle of Jane Street. Downsvicw. and Bryan Wood of 172 Lindylou Road. West- on. were found innocent. Conyers was the one sit- ting by the pickup truck window from which York Regional Police Constable Karl Shaw saw two plastic bags of marijuana thrown while he was pusuing in a police cruiser. Woods had been asleep in the truck since leaving Wood-bridge Tavern a couple of hours before and Gabrielle was driving the truck south on Islington Avenue from Wood- bridge Avenue at 12:45 am September 8. ADMITS RECORD Gabrielle admitted a con- siderable criminal record in- cluding break-in and theft, common assault and theft, but no previous drug con- victions. Both Gabrielle and Wood took the witness stand and swore they didn‘t have the marijuana and didn't know there was any in the truck that night. Conyers elected not to testify and didn’t deny anything. “I was in the Woodbridge Hotel drinking for some time that day. I went to sleep in the back of the truck and woke up in custody. I smoke marijuana. So does Joe Gab- rielle," Wood told the court. “ I do smoke . . .. have for quite a while. I didn‘t know there was any in the truck that night. I didn‘t see any- one throw anything out. . . . Conyers smokes marijuana. most of my friends do," test- ified Gabrielle. MUST OBEY LAW Judge Pearse Said the law is made by the Parliament of Canada and he was on the bench to see the law was obeyed. “If he (Conyers) doesn‘t correct his ways. he's going to end up in jail, no doubt about that." said Judge Pearsei He gave Conyers a $150 fine or 60 days in jail, with until February 2 to pay. The youth also agreed to spend a year on probation under the supervision of a probation officer. Provincial Judge Russell Pearse granted a defense re- quest that evidence at the preliminary hearing not be published until after the trial. A separate hearing was held for Gardner because his co-accused Charles Branget of Stayner was in hospital.
