McCORMICK'S CHOCOLATE CHIP False pretenses, theft, impaired driving cases Hill High law students visit court A group of law students from grade 12 of Richmond Hill High School had a look at the law in action and also talked briefly with one of its administrators last week. The students. ac- companied by their teacher. Mrs Wanda Belza. attended Provincial (‘ourt in Richmond Hill as part of their law course, sitting in on several criminal cases and two show cause hearings. During the morning recess they also talked with Judge Russell Pearse. who answered their questions and gave them a few extra insights into the law beyond their text books. They also learned something about the technical end of court proceedings when Judge Pcarse and Toronto lawyer. t}. J. Elaschuk. debated briefly as to the right of a man who had been con- victed on an impaired driving charge. to retain his driving liconse. his client. Akbar Nizam. 35. of 37 German Mills Road. should be allowed to hold onto his driver's license for the time being. The order could only be made under the Highway Traffic Act. Mr. Elaschuk said. Ilad memorandum Judge Pearse said recent legislation made surrending the license in such cases to the court mandatory. and he wasn‘t going to query the legislation. “If you want to. go ahead.“ he told the defense counsel. K Mart Reg. 3’34 SPECIAL Z PANTIE HOSE However. Judge Pearse admitted he hadn't received official notice as yet. At present. the only such notice was in a memorandum to the court clerk. While that didn‘t make it official. it still meant the accused was under suspension and if he drove his car away from the court parking lot. he would be charged with driving while under suspension. Mr. Elaschuk said he would be driving his client home. Judge Pearse then returned Nizam's license to him. Lawyer right While answering a question from one of the students later. Judge Pearse said the lawyer's argument that he couldn't “go on the memo." was quite right. NEWS He said. also. be was behind in receiving various court documents~“espe- cially in collecting fines"â€" and blamed the current strike of the Toronto mail workers for it. The conviction against Nizam arose out of an in- cident December 14. when police checked him in his car at Leslie Street and Steeles Avenue. A breathalyser test taken showed a reading of 1.6 milligrams of alcohol. sufficient to charge him with having care and control of an automobile over .080. court was told. Nizam pleaded guilty.
