Sumner, 67, of Thor- nhill was given an ab- solute discharge last week on a weapons charge by a judge who earlier expressed sur- prise at the jury‘s guilty verdict. Sumner. a retired contractor living on Sumner Lane. was found guilty of illegal possession of a weapon dangerous to the public peace for brandishing it in front of a guest of his niece who was staying in Sumner’s brother‘s house across the lane. The guest was John McMurtry, brother of Roy McMurtry. now provincial attorney-ge- neral. The absolute discharge means that Sumner will not have a criminal record. The only con dition imposed by County Court Judge Frank Dunlap, was that Sumner not get his revolver back for two years. The judge called the dispute one between two generations. Crown counsel Robert McGee asked for a conditional discharge with probation, seizure of the 38-calibre revolver and an order that Sumner not possess guns or ammunition for up to five years. The Crown referred to two letters written during the trial in which Sumner warned his niece to stay off his property, including the laneway normally used to get to her parents‘ home. His niece Jennifer Sumner lives with McMurtry. The dispute goes back one and a half BAT, EAGLE or PLANE years.
